1. Acceptance of Terms
By creating an account, accessing, or using Bai – Bisaya AI ("Bai," "the Service," "we," "us," or "our"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.
2. Eligibility and Age Requirement
You must be at least 16 years of age to use Bai. By accessing or using the Service, you represent and warrant that you are at least 16 years old. If you are between the ages of 16 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Description of the Service
Bai is a Bisaya-centric artificial intelligence web application developed with SvelteKit and served through Cloudflare Workers. The Service provides conversational chat, Bisaya language education and tutoring tools, semantic search, and the creation of shareable static content cards (HTML components exported to PNG image format).
4. Account Registration and Authentication
Authentication Providers: User authentication is managed using Better Auth, supporting Google Sign-In (GSI) and One-Time Password (OTP) Magic Links delivered to your verified email address.
Account Security: You are responsible for safeguarding access to your email account and any active authentication sessions. You agree to notify us immediately at contact@kumustabai.com if you suspect unauthorized activity.
5. "Load" Credits, Billing, and Purchases
Load System: Bai operates on a credit system designated as "load."
Free Allocation: New or existing eligible accounts receive a complimentary starter allocation of load to access core features at no initial cost.
Paid Top-Ups: Users may purchase additional load packages to replenish credits. Payments are processed securely through our merchant partner, Polar.sh.
Consumption: Each AI interaction, search request, or image generation deducts a designated amount of load based on the computational requirements of the underlying AI model.
6. User Conduct and Restrictions
You agree that you will not use Bai to:
- Generate, transmit, or store content that is unlawful, libelous, defamatory, harassing, abusive, sexually explicit, or that promotes discrimination or harm against any individual or community.
- Bypass or attempt to exploit the load credit balance, authentication tokens, rate limits, or backend Cloudflare Workers endpoints.
- Interfere with server integrity or deploy automated scrapers, bots, or extraction scripts.
- Rely on AI outputs as professional legal, financial, or medical counsel.
7. Intellectual Property and Content Rights
Platform Rights: The Bai name, logo, software code, user interface, and branding are the intellectual property of the operator.
User Inputs: You retain ownership of the prompts and text you provide.
Shareable Generated Content: You are granted full permission to download, publish, and share static PNG images and text generated through your account for personal and lawful commercial purposes. You acknowledge that AI models generate outputs based on probabilistic patterns and that identical or similar outputs may be generated for other users.
Operational License: You grant Bai a non-exclusive, worldwide, royalty-free license to transmit, process, and display your inputs and exported components solely to deliver and maintain your user sessions and saved conversation history.
8. AI Limitations and Disclaimer of Warranties
Informational & Educational Use: Bai utilizes third-party large language models. While fine-tuned and prompted for Bisaya/Cebuano fluency, the Service may occasionally produce inaccurate linguistic translations, regional colloquial discrepancies, or fabricated facts.
"As Is": The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
9. Limitation of Liability
To the fullest extent permitted by law, the individual operator of Bai shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Service, inability to access the platform, loss of data, or reliance on generated content.
10. Governing Law and Jurisdiction
These Terms and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any legal suit, action, or proceeding arising under these Terms shall be instituted exclusively in the competent courts of the Philippines.
11. Termination
We reserve the right to suspend or terminate your account and access to Bai without prior notice if you violate these Terms, engage in fraudulent transactions, or compromise the stability of our infrastructure.
